Sondealrecords.com along with our licensees referred in this Agreement as “us” and “we” and “Sondealrecords.com”) reserves the right to revise this TOS in its sole discretion at any time and without prior notice to you other than by posting the revised TOS on the Site. Any revisions to the TOS are effective upon posting. The TOS will be identified as of the most recent date of revision. It is imperative that you accept our TOS in order to complete your download and sure your continued acceptance of this TOS. Your continued use of the Site after a revised version of this TOS has been posted by Sondealrecords.com to the Site constitutes your binding acceptance of such revision and the revised TOS. Notwithstanding the preceding sentences of this paragraph, no revisions to this TOS will apply to any dispute between you and Sondealrecords.com that arose prior to the date of such revision.
Be comfortable that your purchases will be hassle free. If for whatever reason, you would like to return the item to us, please feel free to contact us directly at sondeal@aol.com. We ONLY accept returns if the exact item is being returned and it is being returned in the original condition and packaging that it dispatched in. Unfortunately, we DO NOT under any circumstances refund ANY shipping cost and there will be no partial cost for the item if it is not returned to us in it’s ORIGINAL condition.
- The Sondealrecords.com Service.com provides a number music Internet-based products specifically in formats of 7”, 10”, 12”, 78” LP’s CD’s, and downloads through the Site (all such products, collectively, the “Sondealrecords.com “Products”). Sondealrecords.com users may create and purchase individual Products for their own personal use through the Site. Users who purchase digital download understand that this download is for personal use only. All commercial use of this download and or alteration will be deemed illegal. Purchaser does not have the right to sell, edit or reproduce said download without the written consent of the Artist(s) and will be deemed as a violation of Sondealrecords and a violation of this site and its TOS and is considered means for legal actions from the Artists(s) for and not limited to copyright infringements along with the terms on a standard Digital Rights Agreement.
Digital Downloads cost are NOT refundable.
- Use of the Site and Sondealrecords.com Service.
(a) International Users: The Sondealrecords.com Service is hosted in the United States.
(1) If you are a customer or client accessing the Sondealrecords.com Service and the Site from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, then please note that you are transferring your personal data to the United States which does not have the same data protection laws as the EU and other regions.
(2) Compliance with TOS and Applicable Law. You must comply with all of the terms and conditions of these TOS, the applicable agreements and policies referred to below, and all applicable laws, regulations and rules when you use the Sondealrecords.com Service and the Site.
- Indemnification. You will indemnify, defend and hold harmless Sondealrecords.com, its officers, directors, employees, shareholders, affiliates, subcontractors, successors and assignees, from and against any and all third-party claims, actions, causes of action, demands, judgments, liabilities, damages, losses, injuries, costs and expenses (including, without limitation, reasonable attorneys’ fees and court costs) brought against Sondealrecords.com that arise from or relate to: (a) any breach or alleged breach by you of any of your representations, warranties or obligations set forth herein; or (b) any claim that Sondealrecords.com’s exercise of the rights granted by you under this Agreement violates any law or regulation or the right(s) of any third party (individually, a “Claim”,and collectively, the “Claims”). You will not consent to the entry of a judgment or settle a Claim without our prior written consent, which may not be unreasonably withheld. You will use counsel reasonably satisfactory to us to defend each Claim. If we reasonably determine that a Claim might adversely affect us, we may take control of the defense at our expense (and without limiting your indemnification obligations).
SONDEALRECORDS makes no guarantee that the files provided for download, viewing or streaming on SONDEAL RECORDS are public domain in your country and assumes no legal responsibility or liability of any kind for their copyright status. Please obey the copyright laws of your country and consult the copyright statute itself or a qualified IP attorney to verify whether a certain file is in the public domain in your country or if downloading a copy constitutes fair use.
